How to obtain the municipal registry having no domicile
One of the material documents that you must obtain as a resident in Spain, whether you are in a regular situation or an irregular one (that is, “without papers”), is the certificate of registration (“padrón municipal” or “empadronamiento”), which you will need for many formalities, including obtaining a Residence and work permit, or the granting of Spanish nationality (citizenship).
What is the certificate of registration.
The municipal register (“padrón de habitantes”) is the administrative registry where all the residents of a municipality (that is, a town or city) are listed. Their data is evidence of both the present residence in the municipality and the permanent domicile in the same. The issued certifications of said data shall be considered public and authentic documents for all administrative purposes.
Every person who lives in Spain is required to register in the Register of the municipality where he / she lives habitually. And the city council in turn must make the inscription after presentation of the corresponding documents.
Documents needed to process the certificate of registration (“volante de empadronamiento”)
The first one is proof of identity. If you do not yet have a residence card, with the NIE number, the valid passport of your country of origin is sufficient.
The second is proof of residence, basically, the property title of the property, or a lease, for example. If you are not the owner of these contracts, you will need a letter from the owner or lessee, authorizing or certifying that you actually live there.
To register without a fixed address
But what if you rented only one room and you cannot, for any reason, get a contract or proof that you live there? Or if you are in a caravan or temporary housing of any type that does not appear in the Real Estate Registry (Catastro) or does not have property documents?
Article 3.3 of the Resolution of 16 March 2015 of the Ministry of the Presidency offers us an alternative. And it is that the social services of the city council make a visit to the place that you indicate as your residence, check that you actually live there and submit a report accordingly.
In that report they do not have to refer either to housing conditions or to the validity of your right to live in the premises. It simply states that they have checked that you live in it, without further analysis.
In some municipalities, such as Barcelona and L’Hospitalet de Llobregat, this is a pretty common procedure regularly applied. For others, however, it is something they do not handle frequently. If the latter is your case, and you do not find much receptivity on the part of the official in charge of the register, please ask him to review the aforementioned Resolution of March 15, 2015.
Muy interesante. No conocía esta posibilidad. Puede constituir una solución a muchas personas que no pueden acreditar de otra manera su residencia.
El artículo está bien pero no me queda claro la utilidad de este tipo de padrón, es decir, ¿en qué casos concretos puede hacerse?, ¿ejemplos?
Hola, María Elena. Un ejemplo es el caso de alguien cuyo casero no quiere (por cualquier motivo) firmarle un contrato de arrendamiento. El servicio social del Ayuntamiento va a la vivienda y confirma si efectivamente la persona vive allí. También el caso de personas que han ocupado una vivienda abandonada, o alguien que vive en una casa rodante o, incluso, personas que viven en hostales o en sitios de acogida.

Te realizo la siguiente consulta: Alquilamos con mi pareja una habitación en BCN en piso compartido dentro de la Ciudad. No hay posibilidades de empadronarme aqui ya que el casero no autoriza empadronamientos. Además de esta opción que comentas de empadronarse sin domicilio fijo (que la podria evaluar)… te comento que tengo un amigo que es propietario de una casa (en las afueras de BCN ciudad) el puede empadronarme en su domicilio? En caso de ser positiva la respuesta… Una vez ya empadronada, podria realizar tramites en BCN Ciudad? Trámites de estancia, residencia, etc? Soy comunitaria y con NIE provisorio de 3 meses de duración y para residir por mas de tres meses en BCN debo inscribirme en el registro de ciudadanos de la UE y me piden estar empadronada para iniciar este tramite. Serviría empadronarme con mi amigo y luego tendría derecho a presentar mis trámites en cualquier organismo público de BCN o solo en el ajuntamiento al cual pertenece el pueblo donde el vive?

Olvide comentarte. El pueblo pertenece a la Provincia de Barcelona, si bien esta a 50 minutos en tren de la Ciudad propiamente dicha. Gracias por tus comentarios.
Hola, María. El registro de ciudadana de la Unión debes hacerlo en la Comisaría Nacional de Policía que corresponda al pueblo donde te empadrones. En principio como ciudadana comunitaria no necesitarás hacer más trámites de extranjería. Si tienes que tramitar una tarjeta de residencia de familiar comunitario, por ejemplo, para un familiar tuyo, éste se hace en la Oficina de Extranjería de Barcelona, previa cita, que tiene jurisdicción para toda la provincia, no sólo la ciudad de Barcelona. tengo una consulta, yo ya estoy empadronado en un domicilio en BCNA pero por circunstancias hemos tenido que abandonar esa casa. el cuento es que para este momento estamos en una habitación en otro ayuntamiento en el cual No nos pueden empadronar por cuestiones económicas, lo delicado de mi situación es que tengo una bebe de 3 años que en teoría debe comenzar el Colegio en septiembre y por razones de colegio debo mover mi padrón a la zona donde estoy por que sino la debería llevar a clases a Barcelona lo cual con Papa y Mama trabajando seria imposible.
Lo cual mi pregunta seria la siguiente: debo mover mi padrón en mi Caso a “Cornella” y para ponerle el plus a la situación este padrón debe ser sin domicilio fijo.

Siempre lo mejor es empadronarse en el nuevo domicilio, si no puedes tener una autorización o copia del contrato de alquiler, acude a los servicios sociales del ayuntamiento, ellos deben visitarte y realizar un informe donde certifican que tu vives allí. Ojo, no se evalúa la vivienda ni nada por el estilo, simplemente se trata de confirmar que vives allí y saber por qué no puedes hacer un padrón convencional.

DAR LAS GRACIAS DE ANTEMANO, LLEVO CASI DIEZ AÑOS VIVIENDO EN UN HOSTAL PERO SE ME DENEGA LA INSCRIPCION EN EL PADRON MUNICIPAL, PUES DICHO HOSTAL DEBE DE ESTAR DADO DE ALTA PARA PODER EMPADRONAR EN COLECTIVO, Y EL GERENTE Y DUEÑO DEL MISMO NO QUIERE HACER DICHO TRAMITE PUES NO ESTA OBLIGADO A ELLO, EL YA ME FIRMO PARA LA SOLICITUD DE EMPADRONAMIENTO PERO ESTE DE BARCELONA DICE QUE YA NO PUEDE HACERSE. NECESITO EMPADRONARME PARA RENOVAR MI CARNET DE LO CONTRARIO ME LO ENVIARAN A UNA DIRECCION QUE NO RESIDO Y ESTE PUEDE EXTRAVIARSE. ¿ COMO PODER EMPADRONARME EN BARCELONA ?
Hola, insiste en que los servicios sociales del ayuntamiento comprueben que físicamente estás viviendo en dicho hostal. Es lo que establece la normativa. Saludos.
