Relocating to Spain with family is, of course, more complicated than doing it alone, and not only for the logistical efforts that this entails, but also for the legal procedures for obtaining the respective residence and work permits for family members. That is why it is convenient that you have a clear understanding of these aspects before embarking on such an important project as moving to another country.<\/p>\n

Relocating to Spain with your family: family reunification<\/h3>\n

The most common way for a foreigner (which is not a citizen of a European Union) to obtain legal status in Spain is through a residence and work permit (whether that work is for the account of others – as an employee – or as a self-employee, merchant or independent professional, for example).<\/p>\n

However, in these cases, the permit is initially granted only to the applicant. If you wish to emigrate to Spain with your family, you should then apply for what is known as family reunification in order to obtain residence permits for your spouse or\u00a0 partner, for your children under the age of 18 (or disabled) or your parents (If they are over 65).<\/p>\n

In order for family reunification to take place, certain conditions must be met, the main being that the sponsor has obtained the renewal of his initial residence. In other words, the holder of a residence permit and work permit can only apply for permits for their relatives when they have more than one year living legally in Spain. In addition, such relatives may not be residing irregularly in Spain at the time of filing the application for reunification.<\/p>\n

Other requirements worth noting are, on the one hand, that it must be demonstrated that the sponsor has been bearing the family’s living expenses in his country of origin for a period prior to the application for reunification and, on the other, that in Spain he\/she has enough economic resources to support himself\/herself and the members of the family he\/she is regrouping, including access to adequate housing.<\/p>\n

Relocating to Spain with family: studies, non-profit residence, entrepreneurs<\/h3>\n

On the contrary, if you come to Spain with a student visa, you can bring your family members simultaneously, as long as you prove that you have enough resources to support them. The same happens if you have applied for a non-profit residence permit, ie you plan to live in Spain without developing any economic activity. In these cases, the requirement of economic solvency is higher than in the case of students, for obvious reasons.<\/p>\n

Also, if you have processed your work permit as an investor, entrepreneur or highly qualified personnel in accordance with Law 14\/2013, of September 27, to support entrepreneurs and their internationalization, the application can include your relatives, always proving that accounts with sufficient resources for the maintenance of these in Spain.<\/p>\n

Relocating to Spain with family:\u00a0 European Union Citizen<\/h3>\n

Royal Decree 240\/2007 (modified by 987\/2015), developing supranational legislation, regulates the right of a citizen of the European Union who decides to reside in Spain, to regroup their family members.<\/p>\n

These cases are not dealt with under the general family reunification scheme, but rather by an apparently simpler mechanism: the granting of a EU family member’s residence card.<\/p>\n

However, this is not automatic, as certain requirements must also be met, such as having sufficient economic resources; as well as that the relative is beneficiary of a private medical insurance (the idea is that it does not become a burden for the Spanish public healthcare system). At the same time, in the case of certain relatives, an economic dependency of these with respect to the European citizen must be demonstrated, which must be continued and prior to the request.<\/p>\n

Immigrating to Spain with family: conclusions<\/h3>\n

These are, broadly speaking, the options that a person who wishes to migrate to Spain with family. Of course, each case has its own particularities and details, so I strongly recommend that you consult with an expert on the subject before making a decision about it.<\/p>\n
